Habermas requires (according to Rorty) really heavy philosophical amunition for the model of Kant: only transcendental conditions of any possible communicative practice can be sufficiently strong to accomplish the task.

It needs a universally existing human ability called practical reason that shows us what is an arbitrary distinction between individuals and what is not.
