Solution/Agamben: "the refugee" can be understood as a "border concept" that "plunges the fundamental categories of the nation state, from the nexus nativity nationality to that of human citizens, into a radical crisis: Thus it becomes possible to clear the field for a categorical renewal that cannot be postponed now, with regard to a policy that no longer separates and expels naked life in the state order, not even through the figure of human rights" (2); cf.
