Böckenförde speaks of a development towards a constitutional state with jurisdiction. (1)
Wrong solution: Judicial self-restriction is not resilient.
Solution/Böckenförde: there is no other way than to return to the understanding of fundamental rights as subjective rights of defence (see Fundamental Rights/Böckenförde).
Constitution/Böckenförde: should accordingly be regarded as a framework for the state and for the relationship between state and citizen, but not as a comprehensive basic order of the community.
