Freedom/Liberalism/Liberality/Constitution/Böckenförde: In the 1970s, Böckenförde turned against the so-called "radical decree" of the German state, which had civil servants and aspiring civil servants examined for their attitude. In the process, people's attitudes to content were checked to see whether they were consistent with the contents of the constitution. One of the reasons for the review was membership of an organization that was described as unconstitutional but not prohibited.
Problem/Böckenförde: this crossed a threshold that led from the rule of the laws to a rule of mind. This contradicted Montesquieu's understanding of freedom:
Def Freedom/Montesquieu: the right to "do everything the law allows". (quoted in (1)).
Freedom/State/Böckenförde: in a liberal state, however, it is precisely education for forming one's own judgement that really counts, which is why loyalty to the basic principles of the liberal constitutional state must be demanded of the teaching staff, but not standardized loyalty. (2) Otherwise, the state runs the risk of losing its liberality.
