Subsidiarity: Subsidiarity in economics is the principle that decisions should be made at the lowest level possible, consistent with their effectiveness. This means that decisions should be made by the people who are most affected by them, and who have the best understanding of the local context. Problem: an apparent contradiction between paternalism (state correction) and liberalism (consumer sovereignty).

Sunstein/Thaler Thesis: It is a mistake to assume that people have always chosen the most preferred alternative; rather, as empirical research in behavioural economics has shown, their choice can be easily influenced by the so-called "framing" of their decision-making situation, by "anchoring" or self-management problems (see in detail Kahneman (3)); a choice according to the standard economic theory of the benefit of expectation is therefore by no means the rule.
