Jurisdiction/Constitutional Court/Constitution/Böckenförde: the German constitution makes constitutional jurisdiction comparatively restrictive: it is a control institution that must not become the master of the constitution.(1) It certainly does not have the task of reforming the Constitution. Rather, the constitutional jurisprudence should be dealing with a strict, intersubjectively verifiable method of argumentation and be oriented towards the dispute to be decided in order to leave the necessary space to the democratic legislator as the institution responsible for standardization and legitimized solely for it.

As a constitutional judge, Böckenförde made this clear in a special vote on a judgement on property taxation in 1995.(2)
