Ernst-Wolfgang Böckenförde on Politics - Dictionary of Arguments
Brocker I 777 Politics/Constitutional Power/Böckenförde: for Böckenförde, politics cannot be completely dissolved into law. (1) The constitutional power produced by the Constitution also has the power to bring the Constitution to an end, whether in a revolutionary act or in a gradual form by undermining the Constitution. The constitutional power can be channelled, but not eliminated. In § 146 of the German Basic Law even the replacement of the constitution by a possible new constitution is made possible. This represents the paradoxical attempt at legalisation in a historically revolutionary situation. ((s) on philosophical problems: see "Exterior/interior".) 1. Vgl.
